Welcome to elev8.These Terms of Service ("Terms") govern your access to and use of the elev8 platform, website, and related services (collectively, the "Platform") operated by elev8 ("elev8," "Company," "we," "us," or "our").By accessing or using the Platform, you agree to be bound by these Terms.If you do not agree, you may not use the Platform.

elev8 provides a professional credibility platform that allows users to:
  • Showcase professional accomplishments
  • Publish and receive peer reviews and recommendations
  • Request verification of accomplishments
  • Access subscription-based premium features
  • Discover and connect with professionals or candidates
elev8 does not:
  • Conduct criminal background checks
  • Guarantee employment
  • Guarantee hiring outcomes
  • Act as an employer, staffing agency, or recruiter
4. User Accounts
To access certain features, you must create an account. You agree to:
  • Provide accurate and current information
  • Maintain the confidentiality of your login credentials
  • Notify us immediately of unauthorized use
You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
5. User Content
A. Ownership You retain ownership of content you submit, including:
  • Profile information
  • Accomplishments
  • Reviews and recommendations
  • Uploaded documentation
B. License to elev8 By submitting content, you grant elev8 a worldwide, non-exclusive, royalty-free license to:
  • Host
  • Store
  • Display
  • Reproduce
  • Modify (for formatting purposes only)
  • Distribute
for the purpose of operating and promoting the Platform.
6. Reviews and Recommendations Policy
Because trust is central to elev8: You agree that reviews and recommendations must:
  • Be truthful and based on real professional experience
  • Not be defamatory, false, misleading, or retaliatory
  • Not violate confidentiality agreements
  • Not include unlawful, discriminatory, or abusive content
Prohibited Conduct You may not:
  • Fabricate reviews
  • Exchange compensation for reviews without disclosure
  • Impersonate others
  • Post knowingly false accomplishments
elev8 reserves the right to remove content that violates these Terms.
7. Accomplishment Verification
When you request verification:
  • You must provide accurate supporting documentation
  • You authorize elev8 to contact references you designate
  • You confirm you have the legal right to share submitted materials
Verification indicates that submitted documentation was reviewed. Verification:
  • Is not a guarantee of employment
  • Is not a certification of overall character
  • Does not represent endorsement by elev8
elev8 is not liable for reliance on verification badges by third parties.
8. Subscriptions & Payments
A. Subscription Plans We may offer subscription-based services to:
  • Candidates
  • Hiring managers
  • Recruiters
Subscription features and pricing will be described on the Platform.B. Billing By subscribing, you agree:
  • To pay all applicable fees
  • That subscriptions may auto-renew unless canceled
  • That payments are processed by third-party payment providers
C. Refunds Unless otherwise stated, subscription fees are non-refundable except as required by law.
9. Acceptable Use
You agree not to:
  • Use the Platform for unlawful purposes
  • Scrape, copy, or harvest data without permission
  • Circumvent security measures
  • Interfere with Platform operations
  • Upload malicious code
  • Misrepresent your identity
10. Intellectual Property
All Platform content (excluding user content), including:
  • Logos
  • Branding
  • Software
  • Design
  • Trademarks
are the property of elev8 or its licensors. You may not copy, distribute, or create derivative works without permission.
11. Privacy
Your use of the Platform is governed by our Privacy Policy.
12. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." elev8 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
We do not guarantee:
  • Employment opportunities
  • Accuracy of user-submitted content
  • Continuous or error-free operation
Users are responsible for evaluating information independently.
13. Limitation of Liability
To the maximum extent permitted by law: elev8 shall not be liable for:
  • Indirect
  • Incidental
  • Special
  • Consequential
  • Punitive damages
including lost profits, employment opportunities, or reputational harm.Our total liability shall not exceed the greater of:
  • The amount you paid in the past 12 months, or
  • $100 USD
14. Indemnification
You agree to indemnify and hold harmless elev8 from claims arising out of:
  • Your content
  • Your misuse of the Platform
  • Your violation of these Terms
  • Your violation of third-party rights
15. Content Removal & Account Termination
We may suspend or terminate accounts if:
  • You violate these Terms
  • We detect fraudulent or abusive behavior
  • Required by law
We may remove content at our discretion.
16. Copyright & DMCA

17. Dispute Resolution & Arbitration
A. Governing Law These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.B. Binding Arbitration Any dispute arising from these Terms shall be resolved through binding arbitration in Delaware, except where prohibited by law.You waive the right to:
  • Trial by jury
  • Participation in class actions
18. International Users
If you access the Platform from outside the United States:
  • You are responsible for compliance with local laws.
  • You acknowledge data may be processed in the United States.
19. Modifications to Terms
We may update these Terms at any time. If changes are material:
  • We will update the "Last Updated" date.
Continued use constitutes acceptance of revised Terms.
20. Severability
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
21. India User Terms
Consent to Personal Data Processing If you access the Platform from India, you are a Data Principal under India's Digital Personal Data Protection Act, 2023 ("DPDP Act"). By registering for the Platform, you provide free, specific, informed, unconditional, and unambiguous consent to elev8's collection and processing of your personal data for the following purposes:
  • Creating and maintaining your candidate profile;
  • Operating the matching and recommendation engine to surface your profile to relevant hiring managers and recruiters;
  • Processing and displaying peer reviews, verifications, and credential confirmations;
  • Sending platform notifications, application status updates, and opportunity alerts (where not opted out); and
  • Conducting bias audits and platform improvement as described in our Privacy Policy.
A notice describing our data collection and processing practices is available in our Privacy Policy.Withdrawal of Consent You may withdraw consent at any time by emailing admin@elev8work.com with the subject line "Withdraw Consent — India". Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal. If you withdraw consent for core processing (profile creation, matching), elev8 may be unable to continue providing the Services to you, and your account may be deactivated.Right to Nominate You may nominate another individual to exercise your rights under the DPDP Act on your behalf in the event of your death or incapacity. Contact our Grievance Officer to register a nomination.Governing Law and Dispute Resolution (India Users) Notwithstanding any other governing law provision in these Terms, if you are an individual accessing the Platform from India, any dispute arising from or relating to these Terms or your use of the Platform shall be governed by the laws of India. The parties will first attempt to resolve any dispute through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Toronto, Ontario, Canada, and proceedings conducted in English. Nothing in this clause limits your right to contact elev8's Grievance Officer or escalate to the Data Protection Board of India for data protection complaints.Grievance Redressal elev8 has appointed a Grievance Officer for users in India, as disclosed in §17 of our Privacy Policy. You may submit any complaint or concern to the Grievance Officer at admin@elev8work.com with the subject line "India Grievance".Partner Hiring Decisions Partners are solely responsible for compliance with jurisdiction-specific AI employment decision laws applicable to their hiring practices, including but not limited to New York City Local Law 144 and any similar state or local legislation. This includes any obligations to notify candidates of automated tool usage and to provide alternative assessment processes where required.
22. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and elev8.
